Noemi Conditi

Noemi Conditi is a lawyer member of the Medical Device Department. Since she joined Studio Legale Stefanelli&Stefanelli, she has been advising in the medical device sector, thus acquiring considerable knowledge of the Reg. EU 2017/745 and its concrete implications. She also provides assistance in the field of compliance for in vitro diagnostic medical devices and personal protective equipment.

She is a PhD student at the University of Bologna in biolaw, focusing on biobanks, privacy, and artificial intelligence in healthcare. During her training, she spent research periods abroad in Belgium, Germany, and Spain.

Moreover, she speaks English and Spanish and therefore she assists in particular international clients.

Online sale of medical devices in Italy: applicable regulatory frameworks

With the entry into force of Regulation 2017/745 (MDR), all doubts have been removed as to whether medical devices can also be sold online. In abstract, medical devices can be sold online through e-commerce sites of one of the economic operators involved in the supply chain (manufacturer, distributor or importer) and in generic marketplaces. Both channels can be directed at consumers and professionals, without distinction. Within this completely liberal framework, however, there are other laws and regulations in force in Italy, different from the MDR, that must be respected in the online sale of medical devices.
