Data protection – the decree harmonizing the Italian legislation to the GDPR has been officially published

On September 4 2018, the Legislative Decree n.101 harmonizing the Italian legislation to the UE Regulation 2016/679 (so-called GDPR) has been published in the Italian Official Gazette.

This legislative provision establishes what parts of the previous privacy and data protection system (Privacy Code and implementing acts) remain in force and what is instead repealed, being incompatible with the new structure of the UE Regulation 2016/679.

It is a very complex provision that is essentially subdivided into two parts.

The first part (up to Article 16) introduces rules that modify the Privacy Code in a very detailed manner (thus creating a "new" Privacy Code which is a somewhat shaky and difficult to read text and doesn’t look anything like the former Code.

The second part introduces instead the methods and the timing for the modification of the legislative acts (authorizations, provisions, code of ethics, etc.) that had been previously issued for the implementation of the Privacy Code.
